This agreement applies to the website, products and services offered under the brand WAAPI, operated by WAAPI (“we”, “us”, “our”), acting as the business. By accessing or using our services you agree to this agreement. If you do not agree, please discontinue use of the services.

Who we are

1. The service

WAAPI provides business messaging and customer-engagement services, on a subscription and/or usage basis. Features, quotas and pricing are described on this website or in your order and may evolve over time. This agreement is between us and customers and the people we message.

2. Account & eligibility

You must be at least 18 years old and legally able to contract. You are responsible for the accuracy of the information you register with, for safeguarding your credentials, and for all activity under your account — including that of your team members and API keys.

3. Acceptable use

You may use the services only for lawful business communication, in line with our Acceptable Use Policy, our Anti-Spam & Messaging Consent Policy, and the policies of every third-party channel you connect (see our Meta Platform Policy and Google API Services disclosure). Spam, unsolicited bulk messaging and unlawful content are prohibited and may lead to immediate suspension without refund.

4. Fees & payment

Charges, billing cycles and accepted payment methods are set out in our Payment Policy and Pricing & Billing Transparency page. All fees are exclusive of applicable taxes (including Tax in India) unless stated otherwise. All payments are final as set out in our Refund & Cancellation Policy.

5. Third-party services

The services interoperate with third-party platforms — messaging channels, advertising platforms, AI providers, payment gateways and cloud infrastructure. Each is listed in our Third-Party Services & Sub-processors register. We are not responsible for those platforms’ availability, pricing or policy decisions, including any restriction they impose on your accounts, numbers or ad spend.

6. Your data & ours

All software, design and content of the platform remain our property or that of our licensors. You retain full ownership of the data and content you upload; you grant us a limited licence to process it solely to provide the services, as described in our Privacy Policy and Data Processing Addendum.

7. Suspension & termination

We may suspend or terminate access for breach of these terms, non-payment, legal requirement, an upstream channel’s enforcement action, or risk to the platform or other customers. You may stop using the services at any time; termination does not entitle you to a refund of amounts already paid.

8. Warranties & liability

The services are provided “as is” and “as available”. To the maximum extent permitted by law, our aggregate liability for any claim is limited to the fees you paid for the service in the three (3) months preceding the event giving rise to the claim. We are not liable for indirect, incidental or consequential damages, or for loss of profits, data or goodwill.

9. Changes

We may update these terms from time to time. Material changes are announced on this website or by email; continued use after the effective date constitutes acceptance.

Governing law & jurisdiction

This document is governed by the laws of India. For operators in India this includes the Information Technology Act, 2000, the Digital Personal Data Protection Act, 2023 (DPDP Act), the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021 and the Consumer Protection Act, 2019. Where we serve customers in other jurisdictions we honour applicable local requirements, including the EU/UK General Data Protection Regulation (GDPR) and the California Consumer Privacy Act (CCPA), to the extent they apply. Courts at India have exclusive jurisdiction, subject to any non-waivable consumer rights in your country of residence.
